CHAPTER VI: STUDENT CONDUCT AND DISCIPLINE
- Disciplinary Authority of the Faculty
- In addition to any other disciplinary action specified herein,
any instructor in charge of a course, with information that a
student in his/her class has cheated or plagiarized may,
after notifying the student of the conduct involved and giving
the student opportunity to respond, take any of the following
actions:
- reprimand the student (verbally or in writing),
- change a grade affected by the cheating or plagiarism,
- assign additional coursework, or
- re-examine any student in connection with the material where
the cheating or plagiarism occurred.
- After notifying the student of the conduct involved and giving
him/her the opportunity to respond (which may be giving him/her
the opportunity to correct the behavior) any instructor in
charge of a course may exclude from his/her class, either temporarily
or permanently, any student who demonstrates offensive or disruptive
conduct toward the instructor or other members of the class.
- When an instructor decides to take any of the disciplinary
actions listed in 1 or 2 above, s/he shall:
- Notify the student of the reason why the student is being disciplined.
- Notify his/her department chairperson so that the department chair
can review the matter, and, in cases where the student is being
permanently excluded from the class, inform the Dean of the College.
- Report the misconduct and disciplinary steps taken in writing to
the office of the Dean of Students. When the misconduct is academically
related, the ``Faculty Report Form for Academically Related Misconduct''
(available from the department or the Dean of Students) shall be filed
with the office of the Dean of Students.
- If the Faculty Report Form for Academically Related Misconduct
indicates that the matter should not be referred to the Student-Faculty
Committee on Student Conduct, the Assistant Dean of Students shall
inform the student of the accusation and that the incident shall
be kept on file in the office of the Dean of Students for the duration
of his/her enrollment at UCSB but that it does not constitute a
``disciplinary record.''
- An instructor may request assistance or an investigation of the
matter by the Dean of Students in order to determine whether
University disciplinary procedures should be invoked. In such
cases, s/he will write a description of the incident in sufficient
detail to permit the Dean of Students to investigate, interview
the witnesses, and, if necessary, prepare the case for a hearing.
- Appeal of faculty implemented discipline:
- A student may appeal the action taken by an instructor by submitting
a written appeal to the department chairperson with a copy to the
Dean of the College. The chairperson may either respond to the appeal
or refer the matter to the Student-Faculty Committee on Student
Conduct for an advisory opinion. (If the department chairperson
is the instructor involved in the case, the letter of appeal should
be forwarded to the Dean of the College.) If the chairperson
refers the case, the Student-Faculty Committee on Student Conduct
will review the evidence and either express its concurrence with the
sanction imposed by the instructor, or recommend a change, listing
the reasons for its recommendation.
- If, after appeal to the department chairperson, the student is not
satisfied with the decision, the student may then appeal to the Dean
of the College. The Dean may also request that the review be made
and an advisory opinion given by the Student-Faculty Committee
on Student Conduct in the manner outlined in 6a above.
